1. Scope of Application

These General Terms and Conditions apply to all services, events and products offered and booked or purchased from Tonkiri Energiearbeit via the website, by email, by telephone or by any other means.

This includes in particular:

Personal consultations and coaching
Ancestor Drumming and shamanic work
Lomi Lomi massages
Akashic Records services and training programmes
Events, seminars and ceremonies
Digital products and content, in particular the Shamanic Journey
Other products and services offered on the website

By booking or purchasing an offer, the customer accepts these General Terms and Conditions.

If the contents of this website, these General Terms and Conditions or other legal provisions are also made available in English, the German version shall be exclusively authoritative. This applies to all website content and, in particular, to all legally binding provisions, agreements and documents. The English version is provided for information purposes only.

3. Offers and Conclusion of Contract

The offers described on the website generally constitute an invitation to book or place an order.

A contract is concluded as soon as Tonkiri Energiearbeit confirms the booking or order or, in the case of digital products, initiates the provision of the purchased product.

The content of the contract shall be determined by the offer description, the stated price and these General Terms and Conditions applicable at the time of booking or purchase.

4. Initial Consultation

Upon request, a free and non-binding initial consultation of up to 30 minutes may be arranged before entering into a personal working relationship.

The initial consultation serves to get to know each other, briefly clarify the customer's concerns and determine whether and in what form a collaboration would be appropriate.

There is no entitlement to subsequent collaboration.

5. Personal Services and Events

The nature, scope and duration of the respective service or event are determined by the relevant offer description or individual agreement.

Tonkiri Energiearbeit provides its services to the best of its knowledge and with due care. No specific personal, health-related or other outcome is guaranteed.

The offers are intended for personal development, awareness work and self-experience. They do not replace medical, psychotherapeutic or other professional treatment.

6. Digital Products

Digital products are provided in electronic form. These may include, in particular, audio files, videos, texts, PDFs and other digital content.

For the Shamanic Journey, the customer receives a personal, non-transferable right of use for private purposes.

The digital content may in particular:

not be passed on to other persons,
not be made publicly accessible,
not be published online,
not be sold or otherwise distributed,
and not be reproduced or used commercially without prior written consent.

The right of use applies personally to the purchaser and, insofar as expressly provided for in the respective offer, to their immediate family.

7. Provision of Digital Products

Digital products are provided following successful payment via the method described in the respective offer, for example by download link or electronic delivery.

The customer is responsible for having a suitable internet connection and the device and software required for use.

If a provided download or access does not function technically, Tonkiri Energiearbeit must be contacted. We will endeavour to resolve technical problems within a reasonable period or provide renewed access that functions properly.

8. Prices and Payment

The prices stated at the time of ordering or booking shall apply.

Unless otherwise agreed, payments are due upon booking or before the start of the service or before provision of a digital product.

The available payment methods are indicated with the respective offer.

9. Cancellation of Personal Appointments

Personal appointments may be cancelled or rescheduled free of charge up to 48 hours before the agreed appointment.

In the event of a later cancellation, 50% of the agreed price may be charged.

In the event of non-attendance without prior cancellation, the full price may be charged.

Different cancellation conditions may apply to events, seminars and training programmes. These will be stated in the respective offer.

10. Right of Withdrawal for Online Purchases

For customers in Switzerland, there is generally no statutory general right of withdrawal for online purchases.

Where customers are entitled to a right of withdrawal under mandatory statutory provisions applicable in their country of residence, these rights shall remain unaffected.

For digital products that are provided immediately after purchase at the express request of the customer, the applicable statutory provisions regarding the right of withdrawal and its possible expiry shall apply.

The required consents and information shall be obtained during the ordering process where necessary.

11. Personal Responsibility and Liability

The use of our offers is generally at the customer's own responsibility.

The customer is responsible for assessing whether an offer is suitable for their individual physical and psychological condition.

Our offers do not replace medical, psychotherapeutic or other professional treatment and, in particular, do not constitute a diagnosis or medical therapy.

No specific results or effects are guaranteed.

We shall only be liable for damages to the extent permitted by law. Liability for damages resulting from intent or gross negligence remains unaffected.

12. Health Requirements

For offers involving intensive personal, physical or psychological self-experience, sufficient physical and psychological stability is a prerequisite for participation. The client assumes full responsibility for their participation.

Persons experiencing acute physical or psychological complaints should seek professional advice before participating.

Medication must never be discontinued, reduced or otherwise changed independently.

Tonkiri Energiearbeit may refuse participation if there are reasonable grounds to believe that an offer is unsuitable or cannot responsibly be provided to the person concerned.

13. Plant-Based Products

Where plant-based products are offered, these are neither medicinal products nor medical treatments.

Such products may only be used in accordance with the respective product description and the instructions provided for their use.

The customer is responsible for clarifying, prior to use, whether health conditions, allergies, medication or other circumstances contraindicate taking the product.

14. Intellectual Property and Copyright

All texts, images, audio files, videos, documents, concepts and other content provided by Tonkiri Energiearbeit are protected by copyright.

Reproduction, publication, distribution, modification or commercial use is not permitted without prior written consent, unless expressly permitted by law.

15. Data Protection

Personal data is processed in accordance with the applicable Privacy Policy of Tonkiri Energiearbeit.

The Privacy Policy provides information in particular about which personal data is collected and processed, for what purposes this is done, which third-party providers are involved and what rights the affected persons have.

The current Privacy Policy can be accessed at any time on the Tonkiri Energiearbeit website.

Personal data is processed in accordance with the applicable Privacy Policy. Where consent is required, it shall be obtained separately.

16. Amendments to the General Terms and Conditions

Tonkiri Energiearbeit reserves the right to amend these General Terms and Conditions where this is necessary due to changes in the range of services, statutory requirements or other objective reasons.

For bookings or purchases already concluded, the General Terms and Conditions applicable at the time the contract was concluded shall generally apply.

17. Applicable Law and Place of Jurisdiction

Swiss law shall apply, excluding its conflict-of-law provisions, unless mandatory statutory provisions provide otherwise.

For customers whose habitual residence is abroad, mandatory consumer protection provisions of their respective country of residence shall remain unaffected.

To the extent permitted by law, the place of jurisdiction shall be the registered office of Tonkiri Energiearbeit.

18. Final Provisions

Should any provision of these General Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.

In place of the invalid provision, the legally permissible provision that comes closest to the economic purpose of the invalid provision shall apply.
